Kilmer Abrego Garcia is once again in the news. In case you don't don't know he is an illegal alien. He has been living in America for at least twelve years. He doesn't have a green card, ant papers or official permission of any kind to be here. He is accused of having involvement with MS-13 and possibly some other gangs operating in the country. His wife says he beat her a few times and she is afraid of him. He was stopped with eight people in the car in what appears to be human trafficking. That was way back in 2019. Eventually he was deported to El Salvador and then returned to the Unites States after much legal wrangling, political pressure, and public outcries from those on the left. He has become the poster child for illegal aliens. The battle cry has become, "due process."
Well, he has had more than his fair share of due process. While everyone seems to be so concerned about that as contained in the 5th and 14th amendments to the constitution, we are overlooking the 6th amendment. The 6th amendment guarantees the right to a speedy trial. This has been dragging on for far too long and needs to be resolved immediately. No one is saying that Garcia isn't guilty of being in the country illegally, that he hasn't been involved with MS-13 and has committed crimes. They only argument is, he hasn't received due process. That is false. What people need to understand about due process is this, you don't get to keep using due process until you get the results you want! That isn't how that works.
The supreme court has stated clearly that due process does apply to everyone, citizen or not. What they haven't said is that due process involves getting the result you desire. Whether you are a citizen or not, the verdict, the decision applies equally. I'd argue that Kilmar Garcia is having his 6th amendment rights violated. I propose he be deported immediately as he has exhausted all of his due process rights. The evidence is clear, he is in the country illegally, has been for a good while, and has received all the benefits of being in the American judicial system. He has not provided any credible evidence that he was seeking asylum. Asylum was denied in his hearing (that was due process) and you don't get to just keep asking until you get what you want.
I say give him his rights under the 6th amendment. Deport him immediately! It's the only fair and legal thing to do supported by the constitution. If you are going to say illegal aliens have the same rights under the constitution as natural born citizens then they have to receive the same treatment. Give him his 6th amendment right! We must not allow any perversion of due process. He has been granted that in accordance with the 5th and14th amendments. That due process denied him asylum. All that remains is to carry out justice, in a speedy and fair manner. It's his constitutional right isn't it? Yes, even when you don't like the result, the law is the law. He's guilty, everyone knows he is guilty and his plea for asylum has been denied. You are outta here!
Garcia has had a trail by immigration judges, not by a public jury. His offense is an immigration issue. He has yet to be officially charged with human trafficking and other charges.
